49CFR Part 40 Regulations Pertaining to DOT Violations
The Department of Transportation under regulation 49CFR Part 40, requires that anyone providing a Substance Abuse Evaluation for DOT personnel, must have received the required training and pass the certification test to be able to provide a Substance Abuse Evaluation by December 31, 2003.
The person providing this service is known as a SAP (Substance Abuse Professional).
In order to first meet the requirements to be a SAP, one must be one of the following: Licensed Physician, Licensed or Certified Social Worker, Licensed or Certified Psychologist, Licensed or Certified Employee Assistance professional, or an alcohol and drug abuse counselor, certified by the National Association of Alcoholism and Drug Abuse Counselors Certification Commission (NAADAC) OR by the International Certification Reciprocity Consortium/Alcohol and other Drug Abuse (ICRC).
The person providing the SAP evaluation must be knowledgeable about and have clinical experience in the diagnosis and treatment of alcohol and controlled substance-related disorders.
